Section 124
Lockout
: (1) In case of strike without giving notice according to this act or if the strike continues or if the collective dispute is not resolved through the process according to this act, the establishment can be locked out after giving a confirmation with justification from the management side and taking the approval of the department.
(2) According to sub-section (1) before the lockout, if the strike is not ended, the manager should issue a notice stating the date of the lockout for the information of the workers at least seven days in advance.
(3) Notwithstanding anything written in sub-sections (1) and (2), during the strike period, if there is a situation where the establishment is damaged due to encirclement by workers, rioting, vandalism, etc., the manager may lock down the establishment. If it is locked in such a way, the information including the justification for the locking must be given to the office or department and the local administration within three days.
(4) If information is received in accordance with sub-section (3), the local administration shall immediately make necessary arrangements for security at such workplace.
(5) If the lockout imposed on an establishment is found to be unreasonable or if it is likely to disturb the peace and security of the country or if it is detrimental to the economic interests of the country, the department may declare such lockout illegal at any time.
(6) Notwithstanding anything else written in this section, no lock-down shall be allowed in an establishment providing essential services.
